A alegação, aceita pela Corte Suprema da Suíça, é de que ele teria manifestado discriminação prévia contra os chineses e, assim, estaria incapacitado de julgar de forma imparcial.
Outro detalhe mencionado hoje é uma piada que Frattini teria feito durante o julgamento quando a mãe de Sun Yang se apresentou como testemunha. Vazou pelo microfone seu comentário dizendo que ela “era uma testemunha muito forte” e riu alto.
